Personal Data may be freely provided by the User, or, in the case of Usage Data, collected automatically when using Fliqr by Modulour.

Unless specified otherwise, all Data requested by Fliqr by Modulour is mandatory, and failure to provide this Data may make it impossible for Fliqr by Modulour to provide its services. Where Fliqr by Modulour specifically states that some Data is not mandatory, Users are free not to communicate this Data without consequences to the availability or functioning of the Service.

Any use of Cookies — or other tracking tools — by Fliqr by Modulour or by third-party services used by Fliqr by Modulour serves the purpose of providing the Service required by the User, in addition to other purposes described in this document and in the Cookie Policy, if available.

Users are responsible for any third-party Personal Data obtained, published, or shared through Fliqr by Modulour, and confirm that they have the third party's consent to provide that Data to the Owner.

Third-party platforms, account actions, and integrations

Fliqr by Modulour integrates with third-party platforms, including Meta (Facebook and Instagram) and Google, to provide its automation and messaging features. Decisions relating to account suspension, restriction, banning, content moderation, or enforcement on those platforms are made solely by the respective platform (e.g., Meta or Google) under their own terms of service and policies. Fliqr by Modulour does not control, influence, or guarantee the outcome of such decisions, and is not responsible or liable for any suspension, restriction, or loss of access a User experiences on a third-party platform, whether or not it occurs in connection with the User's use of Fliqr by Modulour.

Users are responsible for maintaining compliance with the terms of service of any third-party platform they connect to Fliqr by Modulour.

Mode and place of processing the Data

Methods of processing

The Owner takes appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Data.

Data processing is carried out using computers and/or IT-enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition to the Owner, in some cases the Data may be accessible to certain types of persons in charge, involved with the operation of Fliqr by Modulour (administration, sales, marketing, legal, system administration), or to external parties (such as third-party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as Data Processors by the Owner. The updated list of these parties may be requested from the Owner at any time.

The Owner may process Personal Data relating to Users if one of the following applies:

  • Users have given their consent for one or more specific purposes. Note: under some legislations, the Owner may be allowed to process Personal Data until the User objects to such processing ("opt-out"), without relying on consent or any other legal basis below — this does not apply where the processing of Personal Data is subject to European data protection law;
  • provision of Data is necessary for the performance of an agreement with the User and/or for any pre-contractual obligations thereof;
  • processing is necessary for compliance with a legal obligation to which the Owner is subject;
  • processing is related to a task carried out in the public interest or in the exercise of official authority vested in the Owner;
  • processing is necessary for the purposes of the legitimate interests pursued by the Owner or by a third party.

In any case, the Owner will gladly help clarify the specific legal basis that applies to the processing, and in particular whether the provision of Personal Data is a statutory or contractual requirement, or a requirement necessary to enter into a contract.

Place

The Data is processed at the Owner's operating offices and in any other places where the parties involved in the processing are located.

Depending on the User's location, data transfers may involve transferring the User's Data to a country other than their own. Users can check the relevant section of this document to learn more about the place of processing of such transferred Data.

Users are also entitled to learn about the legal basis of Data transfers to a country outside the European Union, or to any international organization governed by public international law or set up by two or more countries (such as the UN), and about the security measures taken by the Owner to safeguard their Data.

Retention time

Personal Data shall be processed and stored for as long as required by the purpose it was collected for. Therefore:

  • Personal Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed.
  • Personal Data collected for the purposes of the Owner's legitimate interests shall be retained as long as needed to fulfill such purposes. Users may find specific information regarding the legitimate interests pursued by the Owner in the relevant sections of this document or by contacting the Owner.
  • The Owner may retain Personal Data for a longer period whenever the User has given consent to such processing, as long as consent is not withdrawn. The Owner may also be obliged to retain Personal Data for a longer period when required to do so for the performance of a legal obligation or upon order of an authority.

Once the retention period expires, Personal Data shall be deleted. Therefore, the right of access, the right to erasure, the right to rectification, and the right to data portability cannot be enforced after the retention period expires.

The purposes of processing

The Data concerning the User is collected to allow the Owner to provide its Service, comply with legal obligations, respond to enforcement requests, protect its rights and interests (or those of Users or third parties), detect malicious or fraudulent activity, and for the following purposes: Access to third-party accounts, Analytics, Contacting the User, Hosting and backend infrastructure, Handling payments, Remarketing and behavioral targeting, Advertising, Registration and authentication, Tag Management, and Interaction with live chat platforms.

Google API Services User Data Policy

Our app complies with the Google API Services User Data Policy, including the Limited Use requirements. We only use user data for the purposes outlined in this privacy policy and do not share or sell user data to third parties. By using our app, you acknowledge and agree to our compliance with the Google API Services User Data Policy.

  • Google Drive — We only read the list of Spreadsheets to allow you to select the Spreadsheet you want to work with.
  • Google Sheets — We allow you to get data from and update your Spreadsheet.
  • Google Calendar — We read the list of events on your calendar to avoid overbooking, and add events to your Calendar when a customer books an appointment.
  • Dialogflow — We use Dialogflow to allow you to automate customer service by detecting user intents only.

Fliqr's use and transfer of information received from Google APIs to any other app will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

Facebook permissions asked by Fliqr by Modulour

Fliqr by Modulour may ask for certain Facebook permissions allowing it to perform actions with the User's Facebook account and to retrieve information, including Personal Data, from it. This connects Fliqr by Modulour with the User's account on the Facebook social network, provided by Meta.

  • Basic information — By default, includes the User's id, name, picture, gender, and locale. Certain connections, such as Friends, may also be available depending on the User's privacy settings.
  • About Me — Access to the 'About Me' section of the profile.
  • Business Management API — Read and write access via the Business Management API.
  • Contact email — Access to the User's contact email address.
  • Instagram basic — Reading an Instagram account's profile information and media.
  • Instagram manage comments — Creating, deleting, and hiding comments on behalf of the linked Instagram account, and reading/responding to public media and comments the business is tagged or mentioned in.
  • Manage Pages — Retrieving access tokens for Pages and Applications the User administers.
  • Managing Page Advertisements — Managing advertisements associated with the Page.
  • Page Messaging — Sending and receiving messages through a Facebook Page.
  • Pages manage engagement — Creating, editing, and deleting comments posted on the Page.
  • Pages manage metadata — Subscribing to and receiving webhooks about Page activity, and updating Page settings.
  • Pages manage posts — Creating, editing, and deleting the User's Page posts.
  • Pages read engagement — Access to content (posts, photos, videos, events) posted by the Page, follower data (name, PSID), profile picture, and metadata/insights about the Page.
  • Pages User locale — Access to the User's locale via the connected Page.
  • Pages User timezone — Access to the User's time zone via the connected Page.
  • Show List of Managed Pages — Access to the list of Pages the User manages.

The rights of Users

Users may exercise certain rights regarding their Data processed by the Owner, including the right to:

The User's Personal Data may be used for legal purposes by the Owner in Court or in the stages leading to possible legal action arising from improper use of Fliqr by Modulour or its related Services. In addition to the information in this privacy policy, Fliqr by Modulour may provide the User with additional and contextual information concerning particular Services or Data processing upon request.

System logs and maintenance

For operation and maintenance purposes, Fliqr by Modulour and any third-party services may collect files that record interaction with Fliqr by Modulour (system logs), and may use other Personal Data (such as the IP Address) for this purpose.

How "Do Not Track" requests are handled

We collect the categories above directly or indirectly from you when you use Fliqr by Modulour — for example, when you submit requests via forms, when you navigate the Service (Usage Data is automatically observed), or from third parties that work with us in connection with the Service.

We may disclose your personal information to a third party for a business purpose under a written agreement requiring the recipient to keep it confidential and use it only for the purposes of the agreement. We may also disclose your personal information when you explicitly ask or authorize us to.

We use your personal information for the operational functioning of Fliqr by Modulour ("business purposes"), as well as for commercial purposes described in the "Detailed information on the processing of Personal Data" section, and for complying with the law and defending our rights. We will not use your personal information for different, unrelated, or incompatible purposes without notifying you.

Your California privacy rights and how to exercise them

The right to know and to portability — You may request disclosure of the categories and sources of personal information we collect, the purposes for which we use it, and with whom it's shared, limited to the past 12 months. Where technically feasible, disclosures will be delivered in a portable format.

The right to request deletion — You may request deletion of your personal information, subject to legal exceptions (e.g., detecting security incidents, fraud protection, exercising legal rights).

How to exercise your rights — Submit a verifiable request via the contact details in this document. We need to reasonably verify your identity and understand your request in sufficient detail to respond.
